What does it mean if there is a seizure on my account?
If a creditor has no other means of being paid, they can apply for a seizure for the owed amount through the court. The resulting court order can be directed against a person or a company.
Authorities can also demand outstanding payments through a seizure. Once Qonto receives and recognizes the seizure order from a court or authority as justified, we are obliged to follow legally established rules.
When will my account block be lifted?
After an account seizure, Qonto is obliged to block all your company’s accounts for outgoing payments until all seizure are paid and settled.
Incoming funds will be transferred to the creditor until the full seizure amount is paid. During this time, no other outgoing transactions can be made.
For seizures against corporations (AG, GmbH, UG) or partnerships (KG, OHG, GbR), we immediately pay outstanding seizure amounts to the creditor.
For sole proprietors, the seizure payment is made after a statutory waiting period of up to 30 days. You can shorten this period by requesting in writing that we settle the outstanding seizure early.
What happens if I have multiple seizures on my account?
Multiple seizures are paid off chronologically, according to the date of receipt.
I have already paid my seizure, how can I unlock my account?
If the seizure has already been paid, we require proof of payment. It must contain the following features:
- The document must be clear (without handwritten notes)
- It must contain the correct amount. If the amount does not match the amount on the seizure order, we cannot accept it.
- The creditor must be listed
- The reference/case number must be included in the document
If any of these details are missing, incorrect, incomplete, or unclear, the proof cannot be accepted.
My seizure has been lifted, how can I unblock my account?
If the seizure has been lifted, we require an official document from the creditor stating that the seizure has been lifted. It must contain the following features:
- Be addressed to us (Olinda)
- Contain your name
- Include the reference number of the seizure
- Include the name of the creditor
- Inform us about the status of the seizure (settled, lifted, etc.)
If any of these details are missing, incorrect, incomplete, or unclear, the proof cannot be accepted.
I have agreed on an instalment payment with the creditor, how can I unlock my account?
If an instalment payment has been agreed upon with the creditor, we also require corresponding proof. It must contain the following features:
- Be addressed to us (Olinda)
- Contain your name
- Include the reference number of the seizure
- Include the name of the creditor
- Inform us about the terms of the instalment payment
If any of these details are missing, incorrect, incomplete, or unclear, the proof cannot be accepted.
